CONSUMER RIGHTS – RIGHT OF WITHDRAWAL – CANCELLATION AND RETURN POLICY

GENERAL:

• By placing an order electronically through our website, you are deemed to have accepted the preliminary information form and the distance sales agreement provided to you.

• Buyers are subject to the provisions of the Law on Consumer Protection No. 6502, the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188), and other applicable legislation in force regarding the sale and delivery of purchased products.

• Shipping costs (delivery charges) belong to the Buyer.

• Each purchased product shall be delivered to the person and/or organization at the address indicated by the Buyer within a legal maximum period of 30 days. If the product is not delivered within this period, Buyers may terminate the contract.

• Each purchased product must be delivered complete and in accordance with the specifications stated in the order, along with documents such as a warranty certificate and user manual, if any.

• In cases where delivery of the purchased product becomes impossible, the Seller must notify the Buyer of this situation in writing within 3 days from becoming aware of it, and the total amount must be refunded to the Buyer within 14 days.

IF THE PURCHASE PRICE IS NOT PAID:

• If the Buyer does not pay the price of the purchased product or if the transaction is canceled in the bank records, the Seller’s obligation to deliver the product ceases.

UNAUTHORIZED USE OF CREDIT CARDS:

• After delivery of the product, if it is determined that the Buyer’s payment was made by unauthorized persons using the Buyer’s credit card unlawfully, and the product price is not paid to the Seller by the relevant bank or financial institution, the Buyer is obliged to return the product to the Seller within 3 days, with shipping costs borne by the Seller.

UNFORESEEN CIRCUMSTANCES (FORCE MAJEURE):

• In cases of force majeure beyond the Seller’s control where the product cannot be delivered on time, the Buyer will be informed. The Buyer may request cancellation of the order, replacement with a similar product, or postponement of delivery until the obstacle is removed.

• If the Buyer cancels the order:

• - If payment was made in cash, the amount will be refunded within 14 days of cancellation.

• - If payment was made by credit card, the amount will be refunded to the relevant bank within 14 days of cancellation. However, the Buyer acknowledges that the bank may take 2–3 weeks to reflect the refund to their account, and the Seller cannot be held responsible for such delays.

BUYER’S OBLIGATION TO INSPECT THE PRODUCT:

• The Buyer must inspect the product/service before accepting delivery; damaged, broken, or defective products (e.g., with torn packaging) must not be accepted from the shipping company. Products accepted upon delivery shall be deemed undamaged and in good condition.

• After delivery, the Buyer is obliged to preserve the product/service carefully. If the right of withdrawal is to be exercised, the product must not be used, and the invoice must also be returned with the product.

RIGHT OF WITHDRAWAL:

• The Buyer may exercise their right of withdrawal, without any legal or penal liability and without providing any reason, by notifying the Seller via the contact information below within 14 (fourteen) days from the delivery of the product to themselves or to the person/institution designated by them.

• In cases caused by the user, the Seller reserves the right to revise the return policy.

WITHDRAWAL PERIOD:

• For services, the 14-day withdrawal period begins on the date of contract signing. If the Buyer consents to commencement of the service before the withdrawal period expires, the right of withdrawal cannot be exercised.

• Expenses arising from the exercise of the right of withdrawal belong to the Buyer.

• To exercise the right of withdrawal, written notice must be sent to the Seller via registered mail, fax, or e-mail within 14 days, and the product must not fall under the category of 'Products Not Eligible for Withdrawal.'

USE OF THE RIGHT OF WITHDRAWAL:

• The invoice of the product delivered to the Buyer or a third party must be returned. (If the invoice is issued in the name of a company, a return invoice prepared by the company must also be sent. Returns cannot be completed without this document.)

• The return form, the product’s box, packaging, and standard accessories (if any) must be delivered intact and undamaged.

RETURN CONDITIONS:

• The Seller is obliged to refund the full amount and all binding documents to the Buyer within 10 days of receipt of the withdrawal notification, and to take back the product within 20 days.

• If the value of the goods decreases or return becomes impossible due to the Buyer’s fault, the Buyer is obliged to compensate the Seller for damages proportionate to their fault. However, the Buyer shall not be held responsible for changes or deterioration caused by proper use of the goods within the withdrawal period.

• If the withdrawal causes the order total to fall below the campaign threshold, any discounts applied under the campaign shall be canceled.

PRODUCTS NOT ELIGIBLE FOR WITHDRAWAL:

• Products prepared in line with the Buyer’s request or clearly personalized, underwear (bottom pieces), swimwear, cosmetics, disposable goods, perishable goods or those likely to expire, products whose packaging is unsealed after delivery and thus not suitable for return for health or hygiene reasons, products mixed with others after delivery and impossible to separate, newspapers and magazines (excluding subscription contracts), instantly delivered digital content or software, and audio or video recordings, books, software programs, data storage devices, and computer consumables if unsealed after delivery, cannot be returned.

• Cosmetics, personal care products, underwear, swimwear, books, software and programs that can be copied, DVDs, VCDs, CDs, cassettes, and stationery consumables (toners, cartridges, ribbons, etc.) can only be returned if their packaging is unopened, unused, intact, and in resalable condition.

DEFAULT AND LEGAL CONSEQUENCES:

• If the Buyer defaults on credit card payments, the Buyer agrees, declares, and undertakes to pay interest in accordance with their agreement with the card-issuing bank and acknowledges liability to the bank. In such cases, the relevant bank may pursue legal remedies, and the Buyer shall be liable for any related expenses and attorney fees. In any case, if the Buyer defaults, they accept to compensate the Seller for damages arising from delayed performance.

• Payments may be made by Bank Transfer or EFT (Electronic Funds Transfer) to one of our TL accounts at Vakıfbank.

• Payments may also be made by credit card via our website. Single-payment and installment options are available for all credit cards. At the end of the order process, the order amount will be charged to the Buyer’s credit card.

• The cancellation and return policy described herein applies to all such transactions.
